New Federal Broadband Privacy Bill IntroducedRep. Blackburn Introduces BROWSER ActRep. Marsha Blackburn (R-Tenn) has introduced a bill that requires broadband services providers to give users notice of their privacy policies and obtain opt-in consent for sensitive data Rep. Marsha Blackburn (R-Tenn.), Chair of the House Subcommittee on Communications and Technology, introduced the ">BROWSER Act (H.R. 2520) to address privacy policies in the wake of the Privacy Congressional Review Act that was signed by President Trump on April 3. The bill requires companies that are providing broadband internet access service (BIAS) and edge services to give users notice of their privacy policies, obtain opt-in consent for sensitive data, and opt-out consent for non-sensitive data. Sensitive information includes financial, health, info pertaining to children under age 13, SSN, geo-location info, content of communications and web browsing history. The bill gives enforcement to the Federal Trade Commission under its "Unfair or Deceptive Act or Practice" authority "notwithstanding the exemption...for common carriers subject to the Communications Act." The bill also preempts state law, as well as provisions of the Communications Act and regulations relating to privacy policies, "unless such regulations pertain to emergency services."
